1. Acceptance of these terms
These Terms of Service govern your access to and use of ClearCrowds, including the ClearCrowds website, web app, mobile app shell, AI photo editing workflows, subscriptions, point purchases, downloads, and related services.
By using ClearCrowds, creating an account, uploading a photo, starting a generation, purchasing a subscription, or buying points, you agree to these terms. If you do not agree, do not use the service.
2. Accounts and eligibility
You are responsible for keeping your account credentials secure and for activity that happens under your account. You must provide accurate information when creating an account or completing checkout.
ClearCrowds may support guest usage. Guest sessions are temporary and may not preserve all history, entitlement, or account data unless you create or sign in to an account.
3. AI photo editing and user content
You keep ownership of photos and prompts you upload, subject to the rights you grant us to process them for the requested editing workflow.
You grant ClearCrowds permission to host, transmit, analyze, transform, and process uploaded content as needed to provide the service, generate results, troubleshoot issues, prevent abuse, and maintain service quality.
For content that ClearCrowds classifies as sensitive but not prohibited, we may provide a temporary processing mode. In that mode, ClearCrowds may create service records for status, billing, expiration, and abuse prevention, but the sensitive source image and generated image are not saved to your library and may expire quickly.
- Do not upload content you do not have the right to use.
- Do not use ClearCrowds to create unlawful, deceptive, harmful, rights-infringing, NSFW, explicit, sexually suggestive, pornographic, or adult entertainment content.
- AI results may be imperfect. Review outputs before publishing, selling, or relying on them.
4. Your responsibility for uploaded content and outputs
Your uploads, prompts, edits, downloads, and use of generated outputs are your own actions. You are solely responsible for ensuring that you have the copyright, publicity, likeness, portrait, privacy, editing, and other rights or permissions needed to upload and process each photo.
You are solely responsible for ensuring that your content, instructions, edits, downloads, publication, distribution, and downstream use of outputs comply with applicable laws and do not violate any third-party rights.
ClearCrowds provides photo editing tools and technical processing. User-submitted content, user instructions, generated outputs, and any downstream use of those outputs are not endorsed, approved, controlled, or represented by ClearCrowds.
The ClearCrowds Acceptable Use Policy is part of these terms and gives more detailed rules for prohibited content, harmful content, identity-related edits, privacy, deceptive commercial edits, and enforcement.
- You must not upload, instruct, generate, or process content involving NSFW, explicit, sexually suggestive, pornographic, fetish, adult entertainment, or erotic content, including AI-generated content.
- You must not upload, instruct, generate, or process content involving terrorism, violent extremism, graphic blood or gore, politically sensitive symbols, restricted political figures or sensitive persons, sexualization of minors, non-consensual intimate content, sexual violence, illegal exploitation, or other unlawful or high-risk content.
- Face-swap, deepfake, impersonation, non-consensual intimate imagery, or edits intended to deceive viewers about a person's identity, consent, or real-world actions are not allowed.
- You must not create, modify, forge, simulate, restore, enhance, redact, or replace information in government-issued or official documents, credentials, records, seals, authentication features, evidence, or materials that appear to be issued by a government, court, regulator, school, bank, employer, or other authority.
- You must not use ClearCrowds for political campaigning, electioneering, voter influence or suppression, lobbying, political fundraising, propaganda, or to create deceptive images of candidates, public officials, elections, public events, or matters of public concern.
- You must not upload or process a person's image without every consent and right required by law, use an output to infringe copyright, privacy, publicity, portrait, likeness, personality, or other rights, or use an output for fraud, impersonation, fabricated evidence, harassment, defamation, unlawful surveillance, evasion, or any other illegal purpose.
- ClearCrowds may refuse, block, delete, disable sharing, disable downloads, expire, or restrict content, accounts, entitlements, or workflows that we believe violate these terms or create legal, platform, payment, provider, safety, or operational risk.
- For sensitive temporary edits, sharing is disabled and downloads may be provided without a ClearCrowds watermark or platform branding.
5. Subscriptions, points, and premium features
ClearCrowds may offer free features, subscriptions, trials, one-time point packs, HD exports, no-watermark exports, and other premium features. Prices, included usage, renewal periods, and feature availability are shown at checkout or inside the app.
Subscriptions renew automatically unless canceled through the applicable checkout provider before renewal. Points and entitlements may be limited by account status, abuse prevention, technical constraints, and the terms shown at purchase.
6. Service availability and changes
ClearCrowds relies on third-party infrastructure, payment processors, AI model providers, app platforms, and storage providers. We may modify, suspend, or discontinue features when needed for security, reliability, legal compliance, or product changes.
We are not responsible for delays, failures, or losses caused by third-party platforms, network issues, app store rules, model provider outages, or user-side device and browser problems.
AI outputs are probabilistic and may be inaccurate, incomplete, unsafe, non-unique, or unsuitable. You must independently review every output and must not rely on it as an authentic record or as legal, medical, financial, safety, identity, or other professional advice.
7. Disclaimers and limitation of liability
To the maximum extent permitted by law, ClearCrowds and its outputs are provided “as is” and “as available,” without implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, or error-free operation.
To the maximum extent permitted by law, ClearCrowds is not liable for indirect, incidental, special, punitive, exemplary, or consequential loss, or for lost profits, revenue, goodwill, opportunity, anticipated savings, or data. ClearCrowds' aggregate liability arising from the service will not exceed the amount you paid ClearCrowds during the 12 months before the event giving rise to the claim.
Nothing in these terms excludes or limits non-waivable consumer rights or liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, or other liability that applicable law does not permit us to exclude.
8. Indemnity
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless ClearCrowds and its affiliates, personnel, and service providers from third-party claims, regulatory proceedings, losses, damages, penalties, and reasonable legal costs arising from your content, instructions, outputs, downstream use, violation of these terms or law, or infringement of another person's rights. This section does not apply to a consumer where prohibited by law or to the extent a claim was caused by ClearCrowds' own breach, gross negligence, or willful misconduct.
